Supervisor Parker called the Board Meeting to order at 7:30
p.m. in the Township Hall.
Pledge of Allegiance was led by the Board of Trustees.
MEMBERS PRESENT Supervisor Parker, Clerk
Montgomery, Treasurer Williams, Trustee Martin, Trustee Carter,
Trustee Orange and Trustee O’Steen.

Motioned by Parker second by Martin to open the hearing at
7:00 p.m.
7:00 P.M. Public Hearing for Johnson Carbide Prod. Industrial
Development
Motioned by Martin second by Carter to close the hearing at
7:14 p.m.
Motioned by Montgomery second by Martin to open the hearing
at 7:15 p.m.

(09-12-01-05) Motioned by Martin second by Carter for the
approval of the
July13, 2005 Special Board Meeting Minutes and the August 22,
2005 Regular Board Meeting Minutes of the Buena Vista Charter
Township Board of Trustees. Motion carried unanimously.
(09-12-02-05) Motioned by Orange second by Martin for
approval to review and approve the statements for accounts
payable and payroll as listed below:
General Fund $213,709.61
Sewer Fund $ 43,379.95
Water Fund $ 56,779.15
Motion carried unanimously by roll call vote.
(09-12-03-05) Motioned by Carter second by Martin to hold
a public hearing to establish a Development District for Johnson
Carbide Products, Inc. which will be held at 7:00-7:15 p.m. at
the Buena Vista Charter Township Office, 1160 S. Outer Drive,
Saginaw, MI 48601. Motion carried unanimously.
(09-12-04-05) Motioned by Carter second by Orange to hold
a public hearing to approve an Industrial Facilities Exemption
Certificate for Johnson Carbide Products, Inc. which will be
held at 7:15-7:30 p.m. at the Buena Vista Charter Township
Office, 1160 S. Outer Drive, Saginaw, MI 48601. Motion carried
unanimously.
(09-12-05-05) Motioned by Carter second by Martin to
establish Industrial Development District Number 14 for Johnson
Carbide Products, Inc., at 1422 South 25th Street,
Saginaw, MI 48601. Motion carried unanimously by roll call vote.
(09-12-06-05) Motioned by Martin second by Montgomery to
approve the request of Johnson Carbide Products, Inc., at 1422
South 25th Street to grant an Industrial Facilities
Certificate for 12 years granting a 50% tax abatement under
Public Act 198 for personal property.
Motioned by Martin second by Montgomery to amend agenda item
09-12-06-05 to read as follows:
(09-12-06-05) Motioned by Martin second by Montgomery to
approve the request of Johnson Carbide Products, Inc. at 1422
South 25th Street, to grant an Industrial Facilities
Certificate for 12 years granting a 50% tax abatement under
Public Act 198 for personal property and for the Township to
receive an annual financial/activity report. Motion carried
unanimously by roll call vote.
(09-12-07-05) Motioned by Carter second by Martin to
approve the application of Thomas R. and Debra K. Kern to enter
29.2 Acres of land into an Act 116 Farmland Agreement with the
State of Michigan. This property is located in Section 36, Town
13 North, and Range 5 East on Wilshire Road in Buena Vista
Charter Township. Local Government approval is a requirement of
the States Act 116 application process. Motion carried
unanimously by roll call vote.
(09-12-08-05) Motioned by Martin second by Carter to
approve to sell part of Buena Vista Charter Township owned
property. To sell 45 feet rear of two lots being parcels number
10-12-5-31-4228-000 and 4229-000 from Township owned parcel
number 10-12-5-31-4016-A00 of Fitzhugh’s Sub-Division, in the
amount of $80.00 plus filing and administration fees of not less
than $25.00; to Mr. Chester J. Brandt, Jr. of 3150 Walters
Street. The two 45 foot extensions are rear of Lots 28 & 29
owned by purchaser and increase the depth of lots to about 194
ft. Motion carried unanimously by roll call vote.
(09-12-09-05) Motioned by Williams second by Montgomery
to approve the purchase of two Haenni WL101 Wheel Load Weigh
Scales from Odometer Corporation, 3 G Nashua Court, Baltimore,
Maryland 21221 for a total cost of $7,190.00. Motion carried
unanimously by roll call vote.
(09-12-10-05) Motioned by Carter second by Martin to
approve the addition of Earl Pegues to the Downtown Development
Authority Board effective immediately. Motion carried
unanimously by roll call vote.
Motioned by Martin second by Orange to accept agenda items
09-12-11-05 through 09-12-17-05 collectively. Motion carried
unanimously.
(09-12-11-05) Motioned by Martin second by Orange to
receive and file August 2005 Monthly Report for the BVCT Fire
Department. Motion carried unanimously.
(09-12-12-05) Motioned by Martin second by Orange to
receive and file the August 2005 Monthly Report for the Buena
Vista Charter Township Police Department. Motion carried
unanimously.
(09-12-13-05) Motioned by Martin second by Orange to
receive and file monthly report for Buena Vista Charter Township
Community Development for August 2005. Motion carried
unanimously.
(09-12-14-05) Motioned by Martin second by Orange to
receive and file the August 2005 monthly report for Park and
Recreation Department. Motion carried unanimously.
(09-12-15-05) Motioned by Martin second by Orange to
receive and file a memo from the Buena Vista School’s
Superintendent Deborah Clark commending Police Chief, Brian
Booker on the department’s participation in the schools district
wide training on Safety, Crisis and Homeland Security
Procedures. Motion carried unanimously.
(09-12-16-05) Motioned by Martin second by Orange to
receive and file an article titled "Congress to consider eminent
domain legislation" from the July 2005 Planning and Zoning News.
Motion carried unanimously.
(09-12-17-05) Motioned by Martin second by Orange to
receive and file and MDOT press release announcing a public
meeting regarding 2006 M-81/I-75 interchange roundabout
construction in Saginaw County to be held at the BVCT Township
Hall on Monday, September 12, 2005 from 3-6p.m. Motion carried
unanimously.
Motioned by Montgomery second by Carter to add agenda item
09-12-19-05 to the agenda. Motion carried unanimously.
(09-12-19-05) Motioned by Martin second by Carter to
approve the second reading and adoption of Zoning Ordinance
Number 245 to amend tax parcel number 10-12-5-09-2010-000
commonly known as 3000 N. Outer Drive and 10-12-5-09-2020-000
commonly known as 2616 N. Outer Drive from A-2 Agricultural to
M-1 Industrial. Motion carried unanimously by roll call vote.
(09-12-18-05) Motioned by Montgomery second by Martin to
approve a closed session meeting to discuss the results of the
Township Manager’s Annual Evaluation. Motioned carried
unanimously.
The Board of Trustees went into Closed Session at 8:40 p.m.
Motioned by Martin second by Carter to reconvene the Regular
Board Meeting at 9:25 p.m. Motion carried unanimously by roll
call vote.
(09-12-18-05) Motion by Montgomery second by Martin to
approve a closed session meeting to discuss the results of the
Township Manager’s Annual Evaluation and to accept the personnel
committee recommendation. Motion carried unanimously by roll
call vote with Supervisor Parker, Trustee Carter and Trustee
Orange voting no.
CLERK’S REPORT
Clerk Montgomery: I just want to state that we had a really
good 911 observation ceremony on yesterday. Hopefully on next
year since this is Annual, that we could get the entire Board’s
participation and to be present. We were lacking in attendance
MANAGER’S REPORT
Mr. Williams: I have two. One is coming up on September 20,
2005 is our take a love one for a check up day from 9:00 am to
5:00 p.m. at the Community Center. Two, you should have a copy
of the complaint process report update for 2005. Year of date
the Township had received 72 complaints, resolved 47 and 25
pending complaints for 2005.

adjourn the meeting at 9:27 p.m. Motion carried unanimously.
