Regular Board Meeting
February 12, 2007

Supervisor Parker called the Board Meeting to order at 7:00 p.m. in the Township Hall.

Pledge of Allegiance was led by the Board of Trustees.

MEMBERS PRESENT Supervisor Parker, Clerk Montgomery, Treasurer Williams, Trustee Martin, Trustee Carter, Trustee Orange and Trustee Ritter

MEMBERS ABSENT None

(02-12-01-07) Motioned by Martin second by Carter for the approval of the

January 22, 2007 Regular Board Meeting Minutes and the January 30, 2007 Special Board Meeting Minutes of the Buena Vista Charter Township Board of Trustees. Motion carried unanimously.

(02-12-02-07) Motioned by Carter second by Martin for approval to review and approve the statements for accounts payable and payroll as listed below:

General Fund $304,380.77

Sewer Fund $ 49,190.09

Water Fund $148,349.05

Motion carried unanimously by roll call vote.

(02-12-03-07) Motioned by Martin second by Montgomery to approve to enter into an option to purchase agreement with Erwin Properties, LLC and Buena Vista Charter Township to purchase and/or control 35.76 vacant acres of real property located at tax identification numbers 10-12-5-31-4059-00 and 10-12-5-31-4016-700 for a period of one-year ending on February 12, 2008 in the amount of $47,500.00. Motion carried unanimously by roll call vote with Treasurer Williams, Trustee Carter and Trustee Orange voting no.

(02-12-04-07) Motioned by Martin second by Ritter to approve the Fitzhugh Inter-County Drainage Board maintenance resolution prepared in accordance with Section 196 of the Michigan Drain Code which is estimated at $31,000.00. Saginaw County’s share of the estimated project is 60% or $18,600.00 and Buena Vista Charter Township’s portion is 25% or $4,650.00 of Saginaw County’s share. Motion carried unanimously by roll call vote.

(02-12-05-07) Motioned by Montgomery second by Carter to approve to sell Buena Vista Charter Township owned parcel #10-12-5-17-4418-000; Section 17, Town 12 North, Range 5 East for the amount of $100.00 plus filing and administration fees of not less than $25.00; to Mr. & Mrs. Edward Marshall, Jr. & June A. Marshall of 3321 Monmouth Street. This single lot parcel is located to the immediate East of buyer’s home. Buyers are seeking to build a new garage on this property. Motion carried unanimously by roll call vote.

Motioned by Montgomery second by Martin to accept agenda items 02-12-06-07 through 02-12-11-07 collectively. Motion carried unanimously.

(02-12-06-07) Motioned by Montgomery second by Martin to approve the resolution honoring Carl Simmit as the 24th recipient of Buena Vista Charter Township’s "80th" Milestone Award. Motion carried unanimously.

(02-12-07-07) Motioned by Montgomery second by Martin to receive and file the January 2007 Monthly Report for the Buena Vista Charter Township Police Department. Motion carried unanimously.

(02-12-08-07) Motioned by Montgomery second by Martin to receive and file the January 2007 monthly report for the Buena Vista Charter Township Fire Department. Motion carried unanimously.

(02-12-09-07) Motioned by Montgomery second by Martin to receive and file the January 2007 monthly reports for the Public Works, Sewer and Water Maintenance Departments. Motion carried unanimously.

(02-12-10-07) Motioned by Montgomery second by Martin to receive and file minutes and communication from Saginaw Area GIS Authority for January 2007. Motion carried unanimously.

(02-12-11-07) Motioned by Montgomery second by Martin to receive and file the Saginaw County Road Commission requested deadlines for the gravel and seal coat projects. Motion carried unanimously.

Motioned by Montgomery second by Carter to add agenda item number 02-12-12-07 to the agenda. Motion carried unanimously.

(02-12-12-07) Motioned by Orange second by Martin to approve to go into closed session for the purpose of discussing a legal opinion regarding the Administrative Consent Order by council for the Township. Motion carried unanimously.

The Board of Trustees went into closed session at 6:30 p.m. instead of conducting the Committee of the Whole.

CLERK’S REPORT

Clerk Montgomery: I just want to thank Vic Killingbeck and Eugene Seals for placing new lights in the gym of the Community Center.
