BUENA VISTA CHARTER TOWNSHIP
Regular Board Meeting
October 22, 2007

Supervisor Parker called the Board Meeting to order at 7:00 p.m. in the Township Hall.

Pledge of Allegiance was led by the Board of Trustees.

MEMBERS PRESENT Supervisor Parker, Clerk Montgomery, Treasurer Williams, Trustee Martin, Trustee Carter, Trustee Orange and Trustee Ritter.

MEMBERS LATE None

Motioned by Martin second by Orange to open the public hearing at 6:30 p.m. Motion carried unanimously.

6:30 P.M. Public Hearing – Fiscal Year 2008 Budget

Motioned by Martin second by Carter to close the public hearing at 7:00 p.m. Motion carried unanimously.

(10-22-01-07) Motioned by Martin second by Ritter for the approval of the

October 8, 2007 Regular Board Meeting Minutes of the Buena Vista Charter Township Board of Trustees. Motion carried unanimously.

(10-22-02-07) Motioned by Martin second by Ritter for approval to review and approve the statements for accounts payable and payroll as listed below:

General Fund $262,195.18

Sewer Fund $ 38,561.64

Water Fund $ 33,933.21

Motion carried unanimously by roll call vote.

(10-22-03-07) Motioned by Martin second by Carter to approve the Buena Vista Charter Township 2007 Tax Millage Rates which supports the 2008 Fiscal Year Budget with the millage rates of: 4.9618 Mills for General Operations; 6.0000 Mills for Police & Fire Operations: and 1 Mill for Community Center Operations; for a total 2007 Property Tax Rate of: 11.9618 per 1000 Dollars of Taxable Value. Motion carried unanimously by roll call vote.

(10-22-04-07) Motioned by Ritter second by Carter to approve $16.00 Fee per each parcel of land from Brush Pick-Up and $146.00 Fee per each Household for Refuse Collection for 2007 Tax Year to support the 2008 Fiscal Year Budget. These rates include cost for services, administrative, depreciation recovery and miscellaneous clean-up expenses including the Townships Annual Spring Clean-Up Day. Motion carried unanimously roll call vote.

(10-22-05-07) Motioned by Carter second by Martin to approve the Street Lighting Assessments for Tax Year 2007 for all 6 Lighting Districts in the amount of $15.44 per Chargeable parcel. Note: This is in support of the 2008 Fiscal Budget and is no change from the 2006 levy. Motion carried unanimously by roll call vote.

(10-22-06-07) Motioned by Orange second by Martin to approve $75.00 per lot or $75.00 per hr for acreage parcels fro Weed cutting effective January 1, 2008 in support of the 2008 Fiscal Year Budget. Note: This fee is the same as it was for the 2007 budget. Motion carried unanimously by roll call vote.

(10-22-07-07) Motioned by Carter second by Montgomery to approve $100.00 as Minimum Bid per Lot of Township Owned Excess Residential Vacant Lands. Additionally, an administrative fee of $25.00 is assessed for processing and recording of Quick Claim deed to successful bidder. Note: These fees support the 2008 Fiscal Budget and are the same as those for 2007. Motion carried unanimously by roll call vote.

(10-22-08-07) Motioned by Ritter second by Martin to approve $200.00 Zoning Changes and/or Variances, plus required cost of publishing legal notices. Currently said publishing cost is estimated at $400.00 to $450.00 each for an initial fee of $650.00 for a Variance and $1,000.00 for Request Change. Note: These fees are in support of the 2008 Fiscal Budget and are the same as were of 2007. Motion carried unanimously by roll call vote.

(10-22-09-07) Motioned by Montgomery second by Martin to approve $500.00 for Developmental and Pilot Projects, plus required cost of publishing legal notices. Currently said publishing cost is estimated at $450.00 each for an initial fee of $950.00 for a Developmental Plan and $1,400.00 for a Pilot Project. Note: These fees are in support of the 2008 Fiscal Budget and are the same as in 2007. Motion carried unanimously by roll call vote.

(10-22-10-07) Motioned by Carter second by Orange to approve to $40.00 for Act 116 Applications & Other Miscellaneous Applications processed by the Township Assessor, plus any required cost of publishing legal notices when applicable. Note: These fees support the 2008 Fiscal Budget and are the same as were charged in 2007. Motion carried unanimously by roll call vote.

(10-22-11-07) Motioned by Carter second by Martin to approve the Mid-Year Splits and Combinations in the amounts of $50.00 for a single parcel split or combination; and $25.00 each additional parcel created or combined as part of split or combination. Note: These fees are in support of the 2008 Fiscal Budget and are the same as were in 2007. Motion carried unanimously by roll call vote.

(10-22-12-07) Motioned by Martin second by Ritter to approve and adopt the Buena Vista Charter Township Budget for Fiscal Year 2008. Motion carried unanimously by roll call vote with Clerk Montgomery and Treasurer Williams voting no.

Motioned by Orange second by Carter to receive and file the monthly report for the Parks and Recreation Department for September 2007. Motion carried unanimously.

Motioned by Martin second by Montgomery to accept agenda items 10-22-14-07 through 10-22-16-07 collectively. Motion carried unanimously.

Motioned by Martin second by Montgomery to receive and file the Michigan Township’s Weekly Legislative Report dated October 12, 2007. Motion carried unanimously.

Motioned by Martin second by Montgomery to receive and file the Preliminary estimate of cost for Pleasant Valley & East Pleasant Valley Subdivision, in the amount of $340,000 dated October 16, 2007. Motion carried unanimously.

Motioned by Martin second by Montgomery to receive and file the Citizens Appreciation Party, Thursday, November 1, 2007 starting at 6:30 – 8:30 p.m. at the Buena Vista Community Center.

TRUSTEE’S REPORT

Trustee Martin: I just have one thing and I just want to say that I realize that we have some tough decisions to make tonight. A part of my job is to make those tough decisions and I want to say that hopefully within six months time that we are going to review the budget again. Nothing is set in stone.

Trustee Ritter: On the Supervisor’s request, I attended a meeting this morning sponsored by MSU Extension and they are basically looking in the Saginaw Valley area to see what kind of potential we have here or interest in dates and economy. Basically such things like the plants.

MANAGER’S REPORT

Mr. Williams: What you have before you in your board packet is a receive and file actually for the month ending September 30, 2007. The percentage to date of the Township should be at 75% and currently we are at 57% under budget. As well I will have full report on Buena Vista’s Blight Deviation Program.
